Yesterday i received Simon Buckingham's response to my complaint to the Law Society regarding his unethical conduct during the legal proceedings that he brought against me - proceedings that were subsequently dismissed.
His response was amusing - in that he appeared to be denying the allegations that i had made against him - yet at the same time he provided proof that what i had alleged was true.
Bizarre behaviour that amused me - so i thought i would share my response to his denials.

I have this afternoon received Simon Buckingham's response to my complaint regarding his conduct. I would like to lodge a response to his denials of misconduct.
I would also like to point out that his behaviour in this matter has caused and continues to cause considerable distress to myself and my family. From the onset of the vexatious legal proceedings that he and Madeleine Flannagan brought against me there has been constant and consistent confusion regarding who is representing who, and who is instructing who. I have had to put up with 2 months worth of constant emails, threats, and harassment from Mr Buckingham and Ms. Flannagan at all hours of the day and night, and they did not take breaks for weekends.
This has and continues to be very distressing for me and my complaint to the Law Society has been made in the faith that they will be unable to cause this much distress to anyone else in the future by using their profession to harass and intimidate another person.
Denial on Point 1 - Please see the attached screenshot of an email from Mr. Buckingham that clearly states that he had filed harassment and defamation proceedings against me that day. (May 2nd). I will also forward the entire email exchange to you separately. Defamation proceedings were never filed - despite Mr.Buckingham stating that they had been.
Denial on Point 2 - Please see attached screenshot of an email from Mr. Buckingham advising me that he had an instructing solicitor - but not advising me who that instructing solicitor was. At 2:59 pm on May the 2nd i queried with Simon who his instructing solicitor was. This was the same day that Simon advised me that he had filed legal proceedings against me the previous day. In Simon's own evidence that he has supplied in his response to my complaint he shows that an instructing solicitor was not acquired until 7:30pm that evening. Simon then responded to me at 9:05pm advising me that he was instructed. Despite Mr. Buckingham's denials - he was not instructed by a solicitor when he began his correspondence with me - or when he filed proceedings against me. It is my belief that lawyers should not be able retrospectively fix their dishonesty and mistakes and that is exactly what Mr. Buckingham has attempted to do in this instance.
Denial on Point 3 - Being a Christian - i found Mr. Buckingham bringing up my faith in God in a conversation regarding a threat of legal proceedings about to be brought against me to be using my faith in God against me. This came across as very unprofessional, insulting, and passive aggressive. I took this as a threat to my faith and that people would not believe that i am a Christian if i did not do whatever Mr Buckingham wanted, or agree to whatever he wanted. It is my view that Mr. Buckingham attempted to use my religious beliefs against me in order to gain a favourable resolution for his clients.
Mr Buckingham has ignored the fact that he sent me a separate letter asking me out for coffee to discuss what i should and shouldn't be able to write about on my blog. A lawyer asking someone out that he has been hired to take to court is unprofessional and amounts to misconduct.
Denial on Point 4 - Simon advised me that he was going to attempt to join the proceedings of his clients with other proceedings that were currently being taken against me. There were no other proceedings being taken against me. For him to now try to backtrack on those threats that he made to me by saying second hand hearsay had led him to make that allegation and threat towards me confirms his unprofessional conduct in these proceedings. The threat that he was going to join his proceedings with other (non existent) proceedings against me was bully tactics. It is my view that he made this threat to intimidate me into believing that there were people lining up to take me to court and that it was going to be me - against a whole group of people. Of course this scared and upset me very much. I spent several weeks feeling intimidated and paranoid about who else was going to take me to court. This was hugely upsetting for me at a time when i had exams and assignments due.
It is my view that Mr. Buckingham should have substantiated the claims that there were other proceedings against me prior to making the threat that there were other proceedings against me.
Denial of Point 5 - It surprises me that Simon Buckingham cannot find any descriptions of his practice. Please refer to Simon Buckingham's emails and letter head where he claims his business is "Buckingham Legal Consultants" which implies that he is actually employed by a Legal Firm when he in fact works on his own - from his home. Mr. Buckingham calling himself "Buckingham Legal Consultants" when he has no employees and works alone is misleading if not completely false. His misleading description of his business is false and meant to intimidate.
Denial of Point 6 - As i stated at the beginning of this email - it was very difficult for any sane person to keep track of who was representing or acting for who throughout this whole process, however on the eve of the court date i received more emails from Mr Buckingham advising me that he was going to attempt to have me charged criminally in this matter, and that he was acting for Ms. Brown - and had been acting for Ms. Flannagan - and then at the actual court appearance he apparently acted for no one.
Denial of Point 7 - Mr Buckingham advised me three days before these proceedings - that were eventually dismissed - that he was going to have me charged criminally. This distressed me to the point where i was scared to answer my door, scared to be at home, scared to leave my teenage children at home, lost sleep, and broke down in tears in front of my family. That Simon is now using an excuse that "He was unsure how to originate a criminal matter" is no excuse for the distress that he caused. I am of the belief that it is the Police that need to originate a criminal matter and if i had acted in a criminal way then the police would have responded to Mr Buckinham and Ms. Flannagan's numerous attempts to have me charged criminally by making complaints against me to the Police. The Police in every instance had advised Mr. Buckingham, and Ms. Flannagan that i had not broken any laws therefor could not be charged with anything criminally. For Mr. Buckingham to make this threat towards me after i had again tried to come to a resolution - out of court - in this matter by removing anything that they wanted removed from my blog is proof of the extent that these lawyers were willing to go to in order to harass me.
Denial of point 8 - Because of the fact that for 6 weeks i had received constant and unrelenting emails from Mr. Buckingham and Ms. Flannagan at all hours of the night - even at 2 and 3am sometimes - and all weekend - i requested that he not contact me again. Their prolific amount of emails to me was distressing and for someone who has no idea regarding legal matters it was all consuming. I had stated previously that i would do whatever they wanted if they would just leave me alone and they refused. I do know though - that from a professional prospective - it is not normal to be sending someone ten emails every single day and that is what i had to put up with from these two lawyers - for 6 weeks.
As all of the proceedings against me were eventually dismissed i find it absolutely unprofessional and harassing that Mr. Buckingham would now still be attempting to get costs out of me. I am a single mother of three and a full time university student. I have no money. It is absolutely distressing that Mr. Buckingham continues to make threats towards me that have no basis.
In the last two months Mr. Buckingham has attempted to encroach on my rights under Freedom of Speech and the Bill of Rights. He has attempted to have me silenced regarding his behaviour. He has made numerous threats against me which have included taking away my right to be on the internet at all, and my right to free speech - all which failed.
Now he is threatening to attempt to get me to pay for his failures.
I have received emails from people that know Mr. Buckingham warning me that he is going to sue me.
Regarding his counter claim that my complaint was made to pervert the course of justice and that i had offered to withdraw the complaint if a resolution was made.
On Monday the 21st of May my partner phoned Mr. Buckingham and advised him that i was willing to remove whatever his clients wanted removed from my blog if they would drop their proceedings. I had come to the decision that this distress and the media attention that Mr. Buckingham and his clients had brought about was not worth standing up for my rights any longer and i wanted to put an end to the matter. The first words out of Simon's mouth were "What about the law society complaint" ...my partner advised that was a separate matter and changed the subject back to the proceedings against me.
The following Friday that week Mr. Buckingham advised that his clients were not willing to settle out of court with me. Later that Friday night i received an email from Ms. Flannagan asking me to contact her if i was willing to settle. During the upset of this conversation where she threatened me that "God's sword of vengeance was about to be mete out on me" i was upset and crying and said i would do whatever they wanted if they would all just leave me alone - i included the Law Society complaint in this "whatever they wanted" because i knew that Simon had brought it up in the phone conversation with my partner.
I am asking the Law Society in good faith to please stop Mr. Buckingham from putting anyone else through the kind of distress that he has caused myself and my family over the past 2 months.

Simon Buckingham's own admission that he was not instructed at the time that he
filed proceedings against me. It was very kind of Madeleine Flannagan to offer Murray Lawes a free lunch in return for supporting this dishonesty though.
Simon advising his clients that he is going to attempt to have my right to be on the internet taken away from me in a "test case". He confirms that all work is being done for free - so basically this was nothing more than three lawyers who held a grudge using their qualifications to bully me. He also defames me in his email by stating that i have "fallen foul of defamation law" previously which is absolutely false. I have never been accused of defamation in court previously or fallen "foul of the law" in that regards. His "test case" subsequently failed.

What i didn't and still don't get regarding his nice letter after his big bad mean letter is that he mentions that i had supported him during the Arie Smith-Voorkamp looting episode in Christchurch.
I never once referred to Simon Buckingham when i blogged about my views on that issue.
I wrote in support of Arie and how disgustingly i thought the media had treated him - parading him in front of the cameras with his injuries - and how disgusting i thought it was that he had received those injuries while in custody.
As far as i am aware The Police - or anyone else - never had to answer how those injuries occurred and no one was punished for that.
As far as i have always been concerned Simon Buckingham completely failed Arie Smith Voorkamp.
He was convicted and no one had to so much as apologise to him for the injuries he sustained while in custody.
Simon's deluded mind thought me supporting his client meant i was supporting HIM.
Wrong.
He failed his client in that case - in my view.

Well - you know what they say Fred - the truth is stranger than fiction and those people are about as strange as it gets!
One key point, Mr Buckingham and Ms Flanagan did not take out proceedings against you. Ms Flanagan did. Mr Buckingham is the lawyer representing her. He is, under our legal system, obliged to take on all cases (the 'cab rank' rule). You cannot complain about a lawyer doing what they are obliged to do by law.
Simon Buckingham's conduct in this matter was unethical - regardless of the fact that by the time this case was actually heard - he was representing NO ONE.
Stop obsessing over me and get your facts right.
But how do you know this when you were not in court by your own admissions here? You are a career wrecker to make yourself look important. The facts do not add up. The judge says on his judgement front page that you published that Mr Buckingham was assisting. So he was aware of the position, yet had no problem. You think a judge would not tell a lawyer off who should not be there?
I have sat back and watched this, and your side of this does not make any sense at all. I hope that Mr Buckingham sues you, if only to stop you hurting others. Who is next in your hate campaign? Damn! If this is christianity, I will become a satanist!!

I have their bible sized pile of papers that made up their dishonest affidavits, I have their their last minute submissions where Debbie Brown advises that Simon Buckingham was no longer representing her (Madeleine Flannagan had decided to represent herself earlier on and i have that in writing as well) and i have the Judge's awesome judgement.

I think Mr Anonymous is also known as Simon Buckingham. The Cab of the Rank rule for lawyers doesn't let you off the hook in terms of ethical obligations. ie A client can't instruct you to lie, break the law, or breach professional obligations.
